SOME WAYS OF DRAINING CRIME PROCEEDS NOT BELONGING TO THE OFFENDER

In the paper the author pointed out on some potentialities and problems related to the drainage of the income from criminal activities by its seizure. The seizure of this income is possible in both cases: from a criminal who cannot be prosecuted or sentenced and where the court refrained from his punishment, and in the case of a third person (an individual or a person of law), which has not been involved in the criminal activity but has profited from such an act. In the end of the presentation the author suggested that there is a possibility to seize the substituted value in cases where the original value is not available.
