NOVELISATION OF THE PUBLIC ASSEMBLY ACT FROM THE PERSPECTIVE OF DEMOCRACY PROTECTION: BAN ON DISGUISING

The goal of this paper is to assess contemporary legal codification that forbids disguising of participants of public gathering in the Czech Republic. The author of this work envisages approaching this topic from the perspective of the novelisation process of the Public Assembly Act, because the considered codification is its integral part. Bearing that in mind there is, first, an outline of the right to public assembly concept including development of its novelization process is presented. Furthermore there follows the assessment of the novelisation discourse with the intention to map the parties concerned and their motivations, all in all dealing with codification of disguising in public. Last chapter focuses on the assessment of legal codification itself perceived from the democratic perspective.
