HEARING OF AN ADMINISTRATIVE INFRA-CTION AND THE PROCEDURE TO ISSUE AN ADMINISTRATIVE ORDER

Hearing of an administrative infraction and the procedure to issue an administrative order have been traditionally understood as special (summary) forms of proceedings in the sphere of administrative infractions. To be complete let us state that in the sphere of Administrative Law there are laws that make it possible to carry out summary proceedings of the delicts that are not explicitly specified as infractions. In some cases such laws directly designate the proceedings as hearings of an administrative infraction, in other cases they only procedurally refer to the Act N. 200/1990 Coll. to regulate infractions, amended by further regulation (thereinafter only “infraction act”). This article therefore focuses only on hearing of infractions in such special forms of proceedings.
