CAN AN EXPERTISE OF AN EXPERT COMMISSION BE USED AS EVIDENCE IN PENAL PROCEEDINGS?

The article highlights the different approaches to evaluating what may be used as evidence in penal proceedings taking into account the provisions of § 89 paragraph 2 of the Penal Code from the side of law enforcement authorities. Especially concerning territorial entries and entries of the Central Expert Commission of the Ministry of Health of the Czech Republic Prague, which have the character of expertise in the field of health service according to provision of article § 4 paragraph 5 Public Notice of the Ministry of Health the Czech Republic No. 221/1995 Coll. of Laws concerning expert commissions. The author holds the view that it is documentary evidence according to provision of § 89 paragraph 2 of the Penal Code.
