TO APPLICATION INSTITUTE VIOLENCE IN JURE

Despite passing nature of violence in human history and decrease of its present occurrence in cultivated companies, however, there still exist situations, when it is necessary on behalf of majority to use the element of violence and force to create respect for social standards and protection of society’s interests. That is the task of law which determines code of human behavior and establishes procedures of the executives when regulating social processes. Therefore the article also contain cases in which it is possible to enter by public force into in other respects inviolable sphere of personal integrity, or possibly, according to the law, to use own self-help and so to contribute to maintain the law without the assistance of the executives. The theory of law classifies this problem as circumstances contradicting lawlessness.
