Issues of Legal Classification of the Offence and the Effectiveness of the Administrative Punishment

The author examines changes in the access to the qualification of the offence in connection with law No. 40/2009 Coll., the criminal code, as amended. The concept of the offence is defined by the provisions of section 13, paragraph 1, this law. The author demonstrates examples from the practice, that the problem of qualification of the offence was not simplified, on the contrary complicated.
