New Power of the Police ČR

In the Czech law there is not any criminal offence which would solve the problem of domestic violence. All criminal activities of this type can be subordinated to individual provisions of the Criminal Code and it concerns the provisions concerning the bodily harm, racketeering, infringement of personal liberty, maltreatment, oppression. In the law on minor infractions such behaviour is solved as minor infractions of civic living together, as minor infractions against public order, etc.
New power of the Police of ČR brings the concept of “order to leave the shared home” for the violent person. This is neither extending nor adding some special criminal act. It is not a sanction, but preliminary measure aimed at isolation of the violent person from the threatened persons in cases which are judged as domestic violence.
