Qualitative Strengthening of Criminal Law Protection from Violence Against Women and Domestic Violence in the EU

Abstract
Violent behaviour takes many different forms and affects many different victims. Empirical evidence has repeatedly pointed to the disproportionately higher impact of violent behaviour on women. The issues of violence against women and domestic violence have been widely discussed at the international level. One breakthrough was the adoption of the Istanbul Convention, which has not been ratified by many countries, such as the Czech Republic. The European Commission is presenting its own initiative – a proposal for a directive on combating violence against women and domestic violence, with the expectation of strengthening protection from violence against women and domestic violence. The aim of this article is to present and analyse the above-mentioned proposal and its criminal law content. In addition to the recent positive legal regulation of domestic violence in the Czech Republic. The article is divided into two parts. The first part deals with the recent protection of women against violence, including domestic violence, from the point of view of selected parts of the valid and effective legislation. The second part deals with an analysis of the proposal for a directive on combating violence against women and domestic violence.
