Application of the Institute of Measures of a General Nature Within the First Coronavirus Wave in the Czech Republic in 2020

The paper deals with one of the most fundamental court decisions in the field of the application of the institute of measures of a general nature during the coronavirus crisis of 2020. In the spring of 2020, the executive bodies intervened through various emergency measures in freedom of movement and enterprise. Some of these measures have been repealed by the courts, in our case due to the absence of a competence requirement for the competent authorities. Interference in fundamental freedoms may be carried out only and under the conditions provided by law and in compliance with the principles of proportionality and appropriateness. Any such an intervention should be issued on the basis of a legal authorization, justified and it should also be a subject to judicial review.
